Researchers Mostafa Fazaeli and Saeed Mokhtari published a new study in the Iranian Journal of International and Comparative Law entitled, “The Right of Palestinian Refugees to Return Palestine from the Perspective of the International Law of Human Rights”.
The article explores the legal status of Palestinian refugees and examines the right of return in international law including the role of nationality, and the principle of genuine link between claimants of the right of return and the country of origin.
It concludes that, considering the current context of the Palestinian historical territories including what is called Israel and the part under the control of the Palestinian state, Palestinian refugees can pursue and demand their right to return. Researchers also found that the passage of time and the refusal of Israel to acknowledge this right do not undermine the existence and validity of the claim for the right of return.
