Mutaz M. Qafisheh, Rama Sahtout, Francesca Albanese and Lex Takkenberg published an article in Global Jurist titled “The Lex Specialis Regime Pertinent to Palestinian Refugees.”
The research looks at the situation of Palestinian refugees based on the “right of return,” with a focus on the ongoing denial of their right to self-determination. The researchers look at this in the context of Palestinian refugees’ unique status created by consistent practice of States showing that their distinction from other refugees because, as the researchers put it “Palestinians ‘refugeehood’ would not end pursuant to the acquisition of other citizenship(s) or by gaining protection akin to citizens in host States”, but rather with the right to return.
This study analyzes the Lex Specialis regime, generated by international law in the case of Palestinian refugees, which affords them “either equal, or heightened, protection and is in no means inferior, to other refugees”. For details of the study and its original source, click here
