The researcher, Iyad Mohammed Abu Mustafa, published in the Journal of Al-Azhar University, issue 23 of 2021, new study entitled: “The principle of military necessity, and violations of the rules of international humanitarian law, in the Isreali operation in Gaza May 2021”. The researcher addressed the state of necessity in armed conflicts and pointed out that stripping this state of its conditions that restrict it, especially the two restrictions “proportionality and discrimination”, is a violation of the rules of international humanitarian law, and this is what Israel has done in May 2021 war on the Gaza Strip. This study reached several conclusions, the most important of which was that “Israel’s failure to adhere to the principle of proportionality, and this comes through its failure to adhere to certain limits in the use of military force, as well as not to abide by the principle of discrimination and the neutralization of civilians from the fire of its weapons.” At the end of the study, the researcher recommended the need to intensify national efforts in cooperation with international institutions to monitor and document war crimes to prosecute Israeli war criminals.
