Researchers Jay Sekulow and Robert Ash published a study in the Social Science Research Network titled: “Why Jewish Settlements in the So-Called ‘West Bank’ are Lawful Under International Law.” This study explores the controversy revolving around whether or not Jewish settlements are lawful in Palestine. The authors try to put forth the argument that Israeli settlements are lawful by claiming there has never been a “State” of Palestine to begin with. They believe that territorial dispute must occur through negotiations only—between Israeli and Palestinian Arab leaders—and that until this happens the status of settlements is lawful under international law.
