The Dutch “Brill” publishing House has published a new paper by Dr Mutaz Qafisheh entitled “What Is Palestine? The de jure Demarcation of Boundaries for the ICC’s ratione loci Jurisdiction and Beyond.” The researcher dealt with the right of the International Criminal Court (ICC) to exercise its ratione loci jurisdiction over Palestine’s territory that includes the West Bank, including East Jerusalem, and the Gaza Strip, given that the legal borders between Palestine and Israel were drawn upon the signing of the armistice agreements between Israel with Jordan and Egypt in 1949. Qafisheh indicated that accepting the contention that the ICC has no competence in a State owing to its unfixed borders may hinder the Court’s ability to prosecute perpetrators in other ICC State Parties with disputed frontiers. Also, he indicated that this would hamper the Court’s authority regarding the non-ICC States with similar border issues. To check the paper, click here
